The Death Penalty Is Justified - 1491 Words
Philosophy In todayââ¬â¢s society, crimes have risen in many forms. People tend to commit crimes even though the government clearly states the consequences for such actions taking place. One prime example is murder. Though people commit murder and acknowledge that the penalty for such act is life in prison, which still doesnââ¬â¢t deter humans from undertaking the act. Death penalty could be a solution to stop humans from committing such gruesome acts. Therefore I strongly believe that the death penalty is acceptable in several cases. Thurgood Marshall states that the death penalty is unconstitutional for two reasons, one that it is excessive. He believes that if the American people were fully informed then they would consider it morally unacceptable. He believes that the death penalty is unnecessary to accomplish any purpose of deterrence or to gain just retribution. Marshall also states that, rather than the death penalty; life in prison would carry out its purpose. I strongly disagree with that statement because the life imprisonment law has been around for centuries and I still hear about murders on a daily base. There isnââ¬â¢t a day without some innocent person being killed by another ruthless person. The individual would know the outcome of such act, which is life in prison, but they still go on with the deed. Marshall also talks about how race would play in the matter on top of wealth and education. The younger generation are also leading the market for multifunctional, low cost furniture, such as DIY kitchens and bathrooms; this is due to the culture of the Chinese families with the kitchen and bathroom being the most personal area in their homes. (Allience, 2007) A major competitor and threat to the DIY businesses already established in China are the growing number of smaller contractors, as their knowledge of DIY is improving with the market trends. A high percentage of new homes being bought are being left unfinished and require a major investment in home improvement, this is where they just decide to hire a smaller contractor to do the time consuming work instead of doing it themselves thus the companies are losing out on the profit, but with Chinaââ¬â¢s property prices rising it is entirely possible that the Chinese consumer will simply be pushed in the direction of DIY as a cheaper option. But what will happen when Chinas sees a fall in construction and property? Will the DIY companies suffer? This can be construed as a major economic threat to new European companies entering into China. Allience, 2007) Who are the major competitors? There is not one but many already established competitors within the Chinese DIY market. Bamp;Q is the major contender with it being the largest Western DIY retailer in the country. Bamp;Q opened its first store in China in 1999 and has continued to establish strong brand awareness. As The Guardian reported, the local culture did not fit with the DIY practices that Bamp;Q already had and therefore Bamp;Q had to adapt their once very successful European format to a Chinese one, hence making it a CIY (create it yourself) strategy. Tran, 2007) Another competitor for an EU DIY business to go up against is a well-established Chinese DIY company called Orient Homes. Orient Homes was founded in 1999 in Beijing. It receives its stock from local m anufacturers consequently lowering the cost of the goods for consumer, thus making it a very large threat not just economically but because it is so well established within its home market. It has come to my attention in according to the China National Interior Decoration Association there is an estimate of more than 40,000 registered companies engaged in home improvement in China alone. (Unknown, 2009) The market is so densely populated that an EU company trying to enter the market is going to have some major struggle. Joint Venture or Wholly Foreign Owned Enterprise (WFOE)? Many companies entering china have to ask themselves this very difficult question, itââ¬â¢s a difficult decision to make as there are many advantages and disadvantages to both. Entering into a WFOE I believe is a lot harder than a Joint Venture, because with no Chinese partner they are left to approach their chosen market alone. Itââ¬â¢s also difficult for the company to ââ¬Å"create a market for their chosen products, especially when thereââ¬â¢re already local competitors. Sometimes even with a local sales and marketing team it can take years to have a name on the Chinese Marketâ⬠(Bergonovo, 2011) . The culture of the market can be very diverse and for a WFOE it can be difficult to understand alone. There are advantages as well as disadvantages, ââ¬Å"unlike in JVs where therere different views because the different partners and the negotiations and compromises are the only key to keep the business alive. Especially for small-medium business it is much better to have a WFOE, in order to avoid getting stuck in cultural differences with a local partner. So if youre a small business maybe with sole ownership in your mother company that has a clear strategy for the Chinese market and can afford long term investment WFOE is the right choice. â⬠(Bergonovo, 2011) Joint Ventures an be very successful in some instances, because you will have the advantage of having a culturally and linguistically adapt partner, but ââ¬Å"itââ¬â¢s crucial for foreign investors to understand the purposes of the joint venture and weather their Chinese Partner is capable of fulfilling them. The popular Chinese idiom ââ¬Å"same bed, different dreamsâ⬠has become the failed joint ventures mant raâ⬠(Ireland, 2012) Trust is the major issue in this venture. My considerations for a DIY company would be a Joint Venture because the company will have a stronger understanding of the market and I believe this is crucial for a successful move to the Chinese market. Are there barriers for new entrants? ââ¬Å"The key difference between domestic marketing and marketing on an international scale is the multi-dimensionality and complexity of the many foreign country markets a company may operate in. An international manager needs a knowledge and awareness of these complexities and their implications they have forâ⬠(Doole amp; Lowe, 2001, p. 9)the company and the market they are entering. I will use the SLEPT (Social, Legal, Economical, Political and Technological) method to determine the various trends and environment for a European DIY company attempting to enter the Chinese DIY market. Social, Cultural problems and differences can really take a toll on a new immature company entering a country where religion and material culture play a major role. The language would have the most significant role and impact to play on the way the products and services many be seen to the new consumers. Coca Cola had huge problems when they first entered the Chinese Market, their brand name translated to ââ¬Å"kooke koulaâ⬠which in turn translated to ââ¬Å"A thirsty mouthful of candle waxâ⬠. Now with their new translation it means ââ¬Å"joyful tastes and happinessâ⬠, mistakes must be made by one major company for another to learn from their mistakes. Over the next 20 years more people will migrate to Chinas cities for higher-paying jobs. These working consumers, once the countrys poorest, will steadily climb the income ladder, creating a new and massive middle class. â⬠(Farrell, Ulrich A. , amp; Stephenson, 2006) This society has struggled to come to terms w ith the phrase ââ¬Å"do it yourselfâ⬠because they are not educated in the home renovation area. It also seems to be giving off the perception that you are peasant like if you do it yourself. Itââ¬â¢s all about social status right now n China, if you are seen doing manual labour that you can subsequently hire someone to do then you are seen as a scrooge. ââ¬Å"In recent years China has become the worldââ¬â¢s number one country in terms of attracting foreign investments. As the second-fastest growing economy of the world it attracted USD 74. 6 billion of foreign direct investment in 2007. With a current position as the worldââ¬â¢s fourth-largest economy (in nominal GDP), and an average annual growth of more than 8% for the last 30 years, only very few other countries in the world can match the business opportunities present in China today. (Unknown, General Considerations before Entering the Chinese Market) In order for an EU DIY company to succeed in the market they need to be aware of what direction the specific market they want to enter is developing economically in order to make a well-rounded assessment on whether it would be financially viable to enter and compete with firms already established in the market such as Bamp;Q and Home Depot. (Doole amp; Lowe, 2001) The company may also face some long term challenges with the rapid development it could put a strain on resources such as the infrastructure and the migration rates within the country. There are also some very appealing political reforms that have taken place in China that any international company would be pleased about. The reform and opening up policy has been a major boost to the Chinese economy and political system. These reforms policies were put in place between 1979 and 1984 and it was aimed at improving Chinese relations with neighbouring countries. Despite the success of this open door policy many companies have been faced with difficult obstacles in relation to ownership rights and intellectual property. It was released this year that the CCP would decrease taxes for foreign companies entering China by 50% as they believed it would attracted more foreign investment in China. (Davies, 2012) ââ¬Å"ââ¬Å"The bigger picture is that because of the economic situation globally over the past couple of years, China sees the need to create a friendlier environment for foreign investors,â⬠said Khoon Ming Ho of KPMG China. â⬠(Davies, 2012) This is a major opportunity for EU based companies to enter the market at reduced tax rates. ââ¬Å"Legal systems vary both in content and interpretation. A company is not just bound by the laws of its home country but also by those of its host countryâ⬠(Doole amp; Lowe, 2001) In the west business is based on careful negotiation in contracts and agreements, they may be enforced by a court of law, however in China business is based on personal relationships, they call Guanxi in China. Two companies have to have guanxi before they can cooperate together, the specifics of a contract me be discussed after they have agreed in principle and this could cause hassle for a European DIY company who base their laws on the west. Technology is currently playing a major role in Chinese society and ââ¬Å"is a major driving force both in international marketing and the move towards the global marketplaceâ⬠(Doole amp; Lowe, 2001) China has the largest mobile phone and internet users with 420 million people using such services daily (Ireland, 2012), leaving the market place wide open for a new EU company to market their products via smartphones and internet. However there are some censorship issues in China at the moment, it is implemented by the Communist Party of China and goes for the whole mainland. Censorship is put into place to uphold and preserve the law of the Communist Party of China; it helps to stop unapprovedà reformist,à separatist, counter-revolutionary, or religious ideas. It also stops the citizens of China educating themselves on the past, present and future let-downs of the Party. Marketing Mix Product With many new foreign products entering the Chinese market the consumers are becoming overwhelmed by the abundance and are relying on the image that the company has made in its producing country. ââ¬Å"Each region in China has differences in economic growth, living standards and education. For foreign products, there are sharp differences between rural and urban attitudes. Typical Chinese consumers do not want to be amongst the first to try a new product. They are reluctant to be pioneers, especially for an expensive, unrecognised (in terms of brand), foreign product. â⬠(Doole amp; Lowe, 2001) My considerations for an EU DIY company would be not to take your companyââ¬â¢s products for granted, just because they have been very successful in the West does not mean they will be equally successful in the East. They must think of China as they would think of Europe, with its many different regions and its many different cultures it must adapt to what are culturally acceptable. They are entirely interested in products that are going to suit their needs, as I spoke of before, when new apartments are bought they are just a shell and need a lot of investment and renovation, if a company could access the Chinese peopleââ¬â¢s needs in this regard they might have a large opportunity. For example; ââ¬Å"Skimming: This is where the product is introduced in the market at a high price, and then lowered over time. (Waller, 2012) Apple Inc. is a company that is partial to this method as they believe that people are willing to pay extra to have the newest technology on the market. ââ¬Å"Prestige: A company will use prestige, or premium pricing as a strategy where companies with luxury products or exclusive brand image/reputation will price the product at the high end of the price range. Customer s knowing that they are buying high quality will expect to pay the higher price. â⬠(Waller, 2012) Companies that use this such method are Louis Vuitton and Rolex. My sector specific considerations for an EU DIY companyââ¬â¢s pricing strategy is to introduce new products at a lower price to suit the Chinese market, leaving them with a competitive advantage over the companies that are already established. Place ââ¬Å"Rapidly improving infrastructure, high-tech facilities and an increasingly well trained workforce mean there is greater choice than ever before for investors seeking to expand, set up new regional headquarters or relocate key functions to new locations within China. (KPMG, 2012) The future of the companyââ¬â¢s success can rely on the choice of location that you choose. ââ¬Å"There is a growing number of young professionals with significant disposable income on the major coastal cities who aspire to higher standards of living and increased wages and thus are more likely to spend credit for mid to high range consumer productsâ⬠(Ireland, 2012) With profit and manufacturing opportunities in major coastal cities this could lead to the start of a very successful DIY company. From as early as 1698 with John Comenius to the most mentioned Jean Piaget in the 1920s? John Comenius was one of the first producers of the childrens picture books. Comenius paved the way for subsequent development in education. His understanding of learning through the senses and of the holistic nature of learning remains the cornerstone of educational theories today. Friedrich Froebel also believed that teachers should not teach by rote but should encourage self-expression through play. He believed that the education of young children was a vital part of their development as individuals. Froebel was the 1st theorist to articulate a theory on how children learn and gave detailed instruction for putting this theory into practice. This was the first teacher training programmer for young children. Rudolf Steiners theory is centered on all aspects of growth and development, which included spirituality. He wanted to create an education which gave children a balanced experience. The teachers attempts to engage the childs whole being in what they do, in as an artistic way as possible, by providing a warm and joyful environment in which the child can feel nurtured and at east, happy to explore and play, be busy and be still. The room is painted and in a warm colour has few hard rectangular corners, and is often furnished with soft muslins to mark off a different area or draped over a window to give a softer quality of light. The quality of sound is that of human voices rather than of mechanical toys. The materials in the room are natural and are at childrens level and are stored in aesthetic containers such as simple baskets or wooden boxes which may themselves be incorporated into the play (Drummond, MJ. Lally M. And Pugh, G. (EDS) (1989) Page 59) (Working with Children: Developin g a Curriculum for Early Years). This theory and concept of teaching has influenced many types of early learning frameworks and curriculums. But his belief in the non-introduction of print to children prior to the age of 7 years remains a controversial part of his theory. As we are aware today, young children have a huge understanding of print, not just from books but from their environment. Maria Montessori was one of the most influential theorists. Her aims were to harness childrens natural ability to learn and then offer defined experiences and materials to explain abstract principles. She wrote the child can only be free when the adult becomes an acute observer. Any action of the adult that is not a response to the childrens observed behaviour limits the childs freedom (cited by MacNaughton in Shaping Early Childhood) (Open University Press, 2003). She developed a range of equipment and materials to help develop the childrens daily living skills such as number concepts, language development, education of senses and exploration and science. Today these methods are still widely used and have been some of the most popular methods of early childhood education in the modern day. Jean Piagets theories dominated developmental psychology in the 1960s and 70s. Like Sigmund Freud, Piaget identified stages of development but while Freud concentrated on the emotional and sexual development, Piaget focused on intellectual development. He identified these 4 stages as Stage 1: Sensorimotor, which was between the ages of 0 2 years. Stage 2: Preoperational, came from the age of 2 to 6/7 years. Stage 3: Concrete Operational, identified itself at age 7 years to 11 years. The final stage, Stage 4: Formal Operations, begins at the age of 12 and continues through into adulthood. His theories were covered during teacher training and influenced the education of young children during the 1970s. Today his theories are still taught but as part of a range of theories. He was created a sense of curiosity about how children learn but his emphasis on logic mathematical thinking resulted in his experiments being over-generalised from a narrow range of subjects. His theories were most influential to the modern curriculum of Highscope. ACTIVITY 1 A Using Highscope within the creche, I can identify many features from Steiner, McMillan, Froebel, Piaget and Melanie Klein. Froebel theorised about the importance of outdoor experience. In our creche we ensure that all the children get outside to play every day. This is an important part of the daily routine, Froebel emphasised nature walks and gardening. The creche has limited outdoor space and the children have plenty to play with, which encourages their gross motor skills. Because of the safety flooring, we have little aspects of gardening outdoors. Melanie Klein believed that children use play to express and show their experiences. This is emphasised within the creche as the majority of the childrens learning/teaching is play-based and to manage challenging behaviour, we re-enact situations through play scenarios, i.e. puppets or stories. But we do not single children out, only observe them in group situations. BC Rudolf Steiners theory concentrates on the child as a whole, balancing the childrens experiences. I can see through observations and toy selection that this is the thesis of our creche. As a supervisor, I see every child as unique. They may go through particular stage but not always at the same time! Each child needs to have positive and constructive experiences which develop their mind, emotions and will. We allow the children freedom of choice and support needed to help them make those choices. With group-time we give them the freedom to speak which builds self-worth and their listening skills. We encourage them to problem-solve which builds their confidence and teaches them patience and respect. But unlike Steiners belief in not introducing them to the printed word, we show the books and flash cards from the babyroom up! McMillan brought the importance of hygiene and nutrition to the forefront. Within the creche we encourage the children to be aware of self-care. Through role-play and story time, we show the children the importance of cleaning hands and face, of brushing their teeth and self-grooming. This is also taught to them through example (staff washing hands regularly, etc.). The creche has a daily well balanced and nutritious menu for the children. We liaise with parents to show them the importance of well balanced meals. Maria Montessori had many contributions to creche curriculum but the one I see regularly in our creche is her theory and observations. The creche revolves around observing the children and planning their routines around that. Adults need to see what the children are interested in and how to enhance that so that their experience is full! Also when observing the children staff can see problems or issues which arise through play situations, i.e. social issues, developmental delays or problems. But we do not use any of the Montessori equipment as we use as much natural material as possible. D Although I can see concept from each theorist, I feel that Steiner/Piaget theories would be the most influential with the creche. Steiners theory about development of the child as a whole person is strong and his emphasis on the importance of play and imitation play a large part in the creche. Piagets theories of development were very influential to the Highscope approach which is used throughout the creche. PART 2 Children love to play! It is an important part of their development. Play offers children the chance to be in control and to feel both confident and competent within relevant and open-ended experiences which are meaningful to them. It helps children make sense of the world around them. Children gain an understanding of their emotions. When children play it involves the exploration of ideas, feelings, relationships, materials and their environment. Play encourages creativity and imagination, and offers the children a chance to explore at their own pace and developmental stage without restriction or expectations. There are different types of play which can overlap and lead into each other. These are symbolic play: The child can use this type of play to reinforce, learn about and imaginatively alter painful experiences. Children mimic parents or pretend to be heroes theyve seen on T.V. or read in a book. This type of play helps children cope with fears. Expressive play: This gives children opportunities to express their feelings by using many different types of materials. Physical play: This has a large social aspect to it because it generally involves other children and it provides exercise which is essential for normal development. Dramatic play: This can be spontaneous or adult-guided. The children act out situations which they feel may happen or are fearful of or may have witnessed. Manipulative play: This starts in infancy. Children control and manipulate their environment and people around them. Children manipulate and move objects to better understand how they work. Familiarisation play: This is when children handle materials and explore experiences in an enjoyable way. Surrogate play: This is when an incapacitated child watches and enjoys through other children or adults. Therapeutic play: This is guided play used by professionals to help children understand their feelings and show them through play. There are three main stages of play which are: (0 2 years) Solitary Play where a child plays alone to explore. (2 3 years) Parallel Play where a child will play alongside other children but not join in. (3-5 years) Sharing Play where children co-operate and use conversation when playing games. This also involves children taking turns and using imagination. Our role as Early Years workers is to facilitate and support each child in play. Through observing practitioners can plan for play. Planning a daily routine and planning the environment around the childs play is important as through planned play a practitioner can best support the children. No matter the age group of the children they need adult support during play. By talking to the children about their play, recognising and supporting their choice of play (without interference) gives children a sense of competence and self-worth. Only participate in childrens play when invited or if you can help them develop the skills of playing. Practitioner can also support by acting as mediator teaching children skills such as problem solving and to be respectful of others feelings. Practitioners knowledge of equality and diversity will protect children from harm in play intervening in satiations that could be potentially harmful for children. Further to practitioners planning and supporting them also need to review play. Observing the children during play can show how the equipment materials and the environment is supporting or maybe hindering the childrens abilities to continue or to progress in the play. Children today are growing up in a society where they are over-protected and parents are fearful of allowing them to play outside and explore houses are made so safe that children are stifled in their development. Things that we did to have fun and play developed our gross motor skills. We problem solved situations so as to stay out longer but today children have a lot of house based games such as PlayStation, etc., which are generally play solely and are intellectually based. I think children coming to an Early Years setting enjoy playing. Having materials and space which is suited and facilitates their interests, means they can express themselves freely and helps them explore and understand the ever changing world around them. As Froebels theory highlighted, children should be allowed to be children and enjoy the things that children enjoy. 1) What is the current framework available in Ireland? Through this scheme, it would be easy for the government to recognize those companies that are not serious in doing their part in order to increase environmental awareness. Malaysia is one of the countries in East Asia that is very committed and willing to intensify their environmental regulation (Perry & Singh, 2001). Just like Singapore, Malaysia is also experiencing environmental hazards like air, water, and grease contamination brought by their economic growth particularly by manufacturing and industrialization. One of the best illustrations is the countryââ¬â¢s Environmental Quality (Amendment) Act of 1996 that regulates th e dumping of hazardous wastes and pollution control. They are also using environmental reporting to promote and improve environmental awareness among businesses by making them more committed and voluntarily communicate their environmental activities. This scheme is highly considered by the government as part of their regulatory practices, and companies on the other hand have accepted the obligation and expanded their responsibilities to the environment. The scheme become widespread considering that the number of participating companies especially those environmentally sensitive industries are increasing (ââ¬Å"The State,â⬠n.d.). This only proved that Malaysiaââ¬â¢s environmental regulation is effective and is strictly implemented. Singapore and Malaysiaââ¬â¢s environmental measures are sufficient considering that they give some positive results, such as companies in different sectors are becoming more transparent in their compliance with environmental regulations throug h environmental reporting. Also, these companies have come to believe that being an environmentally-driven company would give them more profit considering that regulation could bring cost savings (Perry & Singh, 2001). Through this scheme companies have been more willing to pay for environmental improvements, and learned to protect and preserve the environment through ââ¬Å"energy efficiency schemes, waste reduction strategies or the improved design and recyclability of their productsâ⬠(ââ¬Å"An Introduction,â⬠n.d.). Singapore and Malaysia: Wage and Working-Hour Legislation According to the Employment Act of Singapore, the minimum working hours for workers is eight hours a day or a maximum of forty-four hours in one week in absence of agreement (ââ¬Å"Employment Act,â⬠n.d.). In addition, ââ¬Å"Singapore has no minimum wage or unemployment benefitsâ⬠(Global Investment & Business Center, 2008, p. 46). Workers are paid at least once a month subject to employ er-employee negotiation and on what has been stipulated in the employment contract. On the other hand, according to the Employment Act 1955 of Malaysia, the minimum working hours for workers is 8 hours a day and not more than 48 hours in one week with a rest of 30 minutes every after 5 consecutive hours
